Terms of Service

By creating an account or using the DockBook mobile application (the "Service"), provided by Mundi Equity Group Ltd. ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

1. Acceptance of Terms

By using the Service, you represent that you have read, understood, and agree to be bound by these Terms, which constitute a legal agreement between you and Mundi Equity Group Ltd.

2. Unofficial Status & Accuracy Disclaimer

DockBook is an unofficial, third-party tool. It is not affiliated with, endorsed by, or acting on behalf of the ILWU, the ILA, the BCMEA, the PMA, any local, any employer, or any pension, welfare, or benefit plan office or trust fund.

3. Eligibility

You must be at least 18 years of age to use DockBook. By using the Service, you represent and warrant that you meet this age requirement.

4. User Accounts

You must provide a valid email address to use the Service. You are responsible for maintaining the security of your account and password. Mundi Equity Group Ltd. cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.

5. Subscriptions (DockBook Pro)

Certain features require a "DockBook Pro" subscription. Where you subscribe affects how billing, cancellation, and refunds work.

DockBook Pro subscriptions renew automatically until you cancel.

Web subscriptions through dockbook.app are processed by RevenueCat, Inc. as merchant of record, which handles billing, applicable taxes, and the customer portal.

5.3 Cross-platform entitlements

An active subscription entitles you to Pro on iOS, Android, and web when signed in with the same account. Do not hold duplicate active subscriptions across platforms. If duplicates are detected, you are responsible for cancelling the unwanted one on its own platform.

Nothing in this section limits any refund, cancellation, or other right you have under the consumer protection laws of your place of residence.

6. User Generated Content (UGC) & Moderation

DockBook lets you upload vessel photos. Uploads are reviewed by us before they become visible to other users, and DockBook has no messaging, comments, or other direct contact between users.

You may terminate your account at any time through the app's Profile settings or by contacting support@dockbook.ca. Upon termination, all data associated with your account will be permanently deleted within 30 days.

9. Intellectual Property

The Service and its original content, features, and functionality are owned by Mundi Equity Group Ltd. and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW WE DISCLAIM ALL IMPLIED WARRANTIES AND CONDITIONS, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any calculation, estimate, or projection it produces is accurate, complete, or current. Collective agreements, plan rules, and pay rates change, and our interpretation of them may be wrong or out of date.

You acknowledge that you have not relied on any statement, estimate, or projection made by the Service or by us in deciding to accept a dispatch, decline work, claim or forgo a benefit, retire, or take any other action with financial consequences, and that you are responsible for confirming any such matter with the source named in Section 2.

Some jurisdictions do not allow the exclusion of implied warranties, so some of these exclusions may not apply to you. Nothing here limits any non-excludable warranty or condition under the consumer protection laws of your place of residence.

11. Limitation of Liability

To the maximum extent permitted by law, Mundi Equity Group Ltd. shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the Service, including but not limited to:

Our total liability to you for all claims arising from your use of the Service shall not exceed the greater of (a) the amounts paid or payable by you for the Service in the twelve (12) months before the event giving rise to the claim, whether paid to us directly or through an app store on our behalf, and (b) CA$100.

Nothing in these Terms excludes or limits our liability for fraud or fraudulent misrepresentation, for death or personal injury caused by our negligence, or for any other liability that cannot be excluded or limited under applicable law.

You agree to indemnify and hold harmless Mundi Equity Group Ltd., its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

We may modify these Terms. For material changes we will update the "Last updated" date and require you to accept the revised Terms in the app before you continue using the Service. For non-material changes we will update the date and post a notice in the app.

14. Dispute Resolution

Any disputes arising from these Terms or your use of the Service will be resolved through binding arbitration in Calgary, Alberta, Canada, rather than in court, except where prohibited by law. You waive your right to participate in a class action lawsuit or class-wide arbitration.

15. Governing Law

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict of law provisions. Subject to Section 14 (Dispute Resolution), and for any matter not resolved by arbitration under that section, you and we submit to the courts of Calgary, Alberta, Canada.

If you are a consumer, nothing in these Terms deprives you of the protection of the mandatory consumer protection laws of your place of residence, or of your right to bring proceedings there where that right cannot be excluded.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

Sections 2 (Unofficial Status and Accuracy Disclaimer), 10 (Disclaimer of Warranties), 11 (Limitation of Liability), 12 (Indemnification), 14 (Dispute Resolution), 15 (Governing Law), and this Section 17 survive any termination or expiry of these Terms or of your account.

18. Entire Agreement

These Terms and the Privacy Policy are the entire agreement between you and Mundi Equity Group Ltd. about the Service, and they replace any prior understanding. You have not relied on any representation not set out in these Terms, including anything in our marketing, app store listing, or in-app copy.

19. Assignment

You may not assign or transfer these Terms without our written consent. We may assign them to an affiliate or in connection with a merger, acquisition, reorganization, or sale of all or substantially all of our assets.

20. Force Majeure

We are not liable for any failure or delay caused by events beyond our reasonable control, including outages at our hosting or app store providers, network failures, natural disasters, labour disputes, or government action.
