By creating an account or using the DockBook mobile application (the "Service"), provided by Mundi Equity Group Ltd. ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.
1. Acceptance of Terms
By using the Service, you represent that you have read, understood, and agree to be bound by these Terms, which constitute a legal agreement between you and Mundi Equity Group Ltd.
2. Unofficial Status & Accuracy Disclaimer
DockBook is an unofficial, third-party tool. It is not affiliated with, endorsed by, or acting on behalf of the BCMEA, ILWU, PMA, or any official maritime employer or union body.
- Estimation Only: All calculations for earnings, hours, and benefits (including Statutory Holiday pay, Retiring Allowances, and Pension estimates) are approximations for informational purposes only.
- Responsibility: You are solely responsible for verifying all financial information against your official pay stubs and statements. We are not liable for financial discrepancies or decisions made based on app data.
3. Eligibility
You must be at least 18 years of age to use DockBook. By using the Service, you represent and warrant that you meet this age requirement.
4. User Accounts
You must provide a valid email address to use the Service. You are responsible for maintaining the security of your account and password. Mundi Equity Group Ltd. cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.
5. Subscriptions (DockBook Pro)
Certain features require a "DockBook Pro" subscription. Where you subscribe affects how billing, cancellation, and refunds are handled.
5.1 Subscriptions purchased on iOS or Android
If you subscribe through the Apple App Store or Google Play Store:
- Billing: Payments are charged to your store account at the end of any applicable trial period and renew automatically.
- Cancellations: You must manage or cancel your subscription through your device's store settings. Cancellation takes effect at the end of the current billing period.
- Refunds: Refund requests must be made directly through the Apple App Store or Google Play Store in accordance with their refund policies.
5.2 Subscriptions purchased on the web
If you subscribe through dockbook.app, web subscriptions are processed by RevenueCat, Inc. as merchant of record. RevenueCat handles billing, applicable taxes (including Canadian GST/HST/PST where required), and the customer portal.
- Trial: New subscribers to the annual plan may receive a 30-day free trial. The monthly plan does not include a free trial. You will not be charged during any trial period. Only one free trial is permitted per user across all platforms.
- Billing: If you do not cancel before the trial ends, your subscription will automatically convert to paid and renew at the then-current price (currently $3.99 CAD per month or $39.99 CAD per year, plus applicable tax). Subscriptions renew automatically until cancelled.
- Cancellations: You may cancel at any time through Settings → Subscription → Manage subscription within the web app, which opens the RevenueCat-hosted customer portal. Cancellation takes effect at the end of the current billing period; you retain Pro access until that date.
- Refunds: Refund requests for web subscriptions must be sent to support@dockbook.app within 14 days of the original charge. Refunds are issued at our sole discretion and are not guaranteed. Subscriptions cancelled after the 14-day window are not eligible for a refund of the current billing period; access continues to the period end.
- Price changes: We may change subscription pricing for future renewal periods. We will notify you at least 30 days before any price change takes effect, and you may cancel before the change applies.
5.3 Cross-platform entitlements
An active DockBook Pro subscription entitles you to Pro features across all platforms (iOS, Android, and web) when signed in with the same account. You should not maintain duplicate active subscriptions across platforms; if duplicate active subscriptions are detected, you are responsible for cancelling the unwanted subscription on its respective platform.
6. User Generated Content (UGC) & Moderation
DockBook allows users to post vessel photos, operational notes, and intelligence reports. We are committed to maintaining a safe and respectful community.
- Zero Tolerance Policy: There is zero tolerance for objectionable content. You may not post material that is offensive, illegal, defamatory, pornographic, promotes harassment, contains profanity, violates privacy rights, or infringes intellectual property rights.
- License to Content: By posting content, you grant Mundi Equity Group Ltd. a worldwide, non-exclusive, royalty-free license to use, reproduce, and display your content within the Service.
- Enforcement: We reserve the right to remove content and ban users immediately for violations.
- Reporting: Users can report any content that violates these terms. Reports are reviewed within 24 hours.
7. Prohibited Uses
You agree not to:
- Use the Service for any illegal purpose
- Attempt to gain unauthorized access to any portion of the Service
- Interfere with or disrupt the Service or servers
- Impersonate any person or entity
- Upload viruses or malicious code
- Harvest or collect user information without consent
- Use automated systems to access the Service without permission
8. Account Termination
We reserve the right to terminate or suspend your account at any time for:
- Violation of these Terms of Service
- Posting objectionable content
- Fraudulent or abusive behavior
- Prolonged inactivity (accounts inactive for over 2 years may be deleted)
You may terminate your account at any time through the app's Profile settings or by contacting support@dockbook.ca. Upon termination, all data associated with your account will be permanently deleted within 30 days.
9. Intellectual Property
The Service and its original content, features, and functionality are owned by Mundi Equity Group Ltd. and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
10. Limitation of Liability
To the maximum extent permitted by law, Mundi Equity Group Ltd. shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the Service, including but not limited to:
- Loss of profits or revenue
- Loss of data
- Business interruption
- Financial decisions made based on app calculations
Our total liability to you for any claims arising from your use of the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless Mundi Equity Group Ltd., its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any rights of another user
- Content you post to the Service
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the "Last Updated" date and posting a notice within the app. Your continued use of the Service after changes constitutes acceptance of the revised Terms.
13. Dispute Resolution
Any disputes arising from these Terms or your use of the Service will be resolved through binding arbitration in Calgary, Alberta, Canada, rather than in court, except where prohibited by law. You waive your right to participate in a class action lawsuit or class-wide arbitration.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of Calgary, Alberta, Canada.
15. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
